Consequences of High BAC Levels

Excessive blood alcohol content, also known as extreme BAC, is a special allegation that can increase the penalties you face if you are convicted of DUI. There are two levels of excessive BAC, each of which has specific consequences under California law:

  • .15 or higher: If you are found guilty of driving with a BAC of .15 or higher, you will be required to use an ignition interlock device when you regain your driver’s license. The judge may also refuse to grant probation or place special restrictions on your probation.
  • .20 or higher: If you are found guilty of driving with a BAC of .20 or higher, you will be required to attend a drug and alcohol abuse program for nine months, as opposed to the usual three months. The judge may also impose additional penalties.
